利用規約Terms of Service

第1条（適用）Article 1 (Application)

本利用規約（以下「本規約」）は、株式会社エコーズエンターテインメント（以下「当社」）が運営するブランド「Cuepost」およびHub Seriesに属するアプリケーション（Troute Hub、以下総称して「本サービス」）の利用に関する条件を定めるものです。利用者は、本サービスを利用することにより、本規約に同意したものとみなされます。These Terms of Service ("Terms") set forth the conditions for use of the brand "Cuepost" and Hub Series applications (Troute Hub, collectively "the Services") operated by Echoes Entertainment Inc. ("the Company"). By using the Services, users are deemed to have agreed to these Terms.

第2条（定義）Article 2 (Definitions)

本規約において「利用者」とは、本サービスに登録し、または本サービスを利用する全ての方を指します。「コンテンツ」とは、利用者が本サービスを通じて投稿、送信、またはその他の方法で利用可能にした情報（テキスト、画像等）を指します。"User" refers to anyone who registers for or uses the Services. "Content" refers to information (text, images, etc.) that users post, transmit, or otherwise make available through the Services.

第3条（アカウント登録）Article 3 (Account Registration)

利用者は、正確かつ最新の情報を提供してアカウント登録を行うものとします。登録情報に変更が生じた場合は、速やかに更新してください。アカウントの管理責任は利用者にあり、第三者への譲渡・貸与はできません。Users shall register with accurate and current information. If registration details change, update them promptly. Users are responsible for managing their accounts; transfer or lending to third parties is prohibited.

第4条（料金および支払い）Article 4 (Fees and Payment)

本サービスの有料プランの料金は、各サービスページに記載の通りとします。支払いはクレジットカード（Stripe決済）により行われ、月額プランは毎月、年額プランは毎年自動更新されます。料金は税込表示です。当社は、事前に通知した上で料金を変更することがあります。Fees for paid plans are as listed on each service page. Payment is made by credit card via Stripe, with monthly plans renewed monthly and annual plans renewed yearly. Prices include tax. The Company may change fees with prior notice.

第5条（解約・返金）Article 5 (Cancellation and Refunds)

利用者は、次回更新日の前日までに解約手続きを行うことで、次期以降の課金を停止できます。解約後も、お支払い済みの期間中は引き続きサービスをご利用いただけます。デジタルサービスの性質上、お支払い後の返金はお受けしておりません。Users can stop future charges by cancelling before the day before the next renewal date. After cancellation, the service remains available until the end of the paid period. Due to the nature of digital services, refunds are not available after payment.

第6条（禁止事項）Article 6 (Prohibited Activities)

利用者は、以下の行為を行ってはなりません。Users shall not engage in the following activities:

（1）法令または公序良俗に反する行為
（2）犯罪行為に関連する行為
（3）本サービスのサーバーまたはネットワークに過度な負荷をかける行為
（4）本サービスの運営を妨害する行為
（5）他の利用者の個人情報を不正に収集・蓄積する行為
（6）不正アクセスまたはこれを試みる行為
（7）第三者になりすます行為
（8）本サービスのアカウントを第三者に譲渡・貸与する行為
（9）当社の知的財産権を侵害する行為
（10）その他、当社が不適切と判断する行為(1) Acts that violate laws or public order
(2) Acts related to criminal activity
(3) Acts that place excessive load on service servers or networks
(4) Acts that interfere with service operations
(5) Unauthorized collection or accumulation of other users' personal information
(6) Unauthorized access or attempts thereof
(7) Impersonation of third parties
(8) Transfer or lending of accounts to third parties
(9) Acts that infringe the Company's intellectual property rights
(10) Other acts deemed inappropriate by the Company

第7条（サービスの変更・停止）Article 7 (Service Changes and Suspension)

当社は、以下の場合に本サービスの全部または一部を変更、中断、または終了することがあります。
（1）システムの保守・点検・更新を行う場合
（2）地震、落雷、火災、停電その他の不可抗力により提供が困難となった場合
（3）その他、当社がやむを得ないと判断した場合
サービスの変更・中断・終了により利用者に損害が生じた場合でも、当社は一切の責任を負いません。The Company may change, suspend, or terminate all or part of the Services in the following cases:
(1) System maintenance, inspection, or updates
(2) Force majeure events such as earthquakes, lightning, fire, or power outages
(3) Other cases deemed unavoidable by the Company
The Company bears no liability for damages to users caused by service changes, suspension, or termination.

第8条（知的財産権）Article 8 (Intellectual Property Rights)

本サービスに関する知的財産権は全て当社に帰属します。利用者は、本サービスを通じて提供される情報を、当社の事前の書面による同意なく、複製、転載、改変、販売その他二次利用することはできません。All intellectual property rights related to the Services belong to the Company. Users may not reproduce, repost, modify, sell, or otherwise secondarily use information provided through the Services without prior written consent from the Company.

第9条（免責事項）Article 9 (Disclaimer)

当社は、本サービスの内容、品質、正確性、信頼性、安全性、適法性等について、明示的にも黙示的にも一切の保証をいたしません。本サービスの利用により利用者に損害が生じた場合でも、当社の故意または重過失による場合を除き、当社は一切の責任を負いません。当社が責任を負う場合であっても、その範囲は利用者が直近12ヶ月間に支払った利用料金の総額を上限とします。The Company makes no warranties, express or implied, regarding the content, quality, accuracy, reliability, safety, or legality of the Services. The Company bears no liability for damages to users from use of the Services, except in cases of willful misconduct or gross negligence. Even where the Company is liable, compensation is limited to the total fees paid by the user in the preceding 12 months.

第10条（個人情報の取り扱い）Article 10 (Handling of Personal Information)

利用者の個人情報の取り扱いについては、別途定めるプライバシーポリシーに従うものとします。Handling of users' personal information shall follow our separate Privacy Policy.

第11条（規約の変更）Article 11 (Changes to Terms)

当社は、必要と判断した場合、利用者への事前通知をもって本規約を変更することができます。変更後の規約は、当社ウェブサイトに掲載された時点で効力を生じるものとします。The Company may change these Terms with prior notice to users when deemed necessary. Revised Terms take effect upon posting on the Company's website.

第12条（準拠法・管轄裁判所）Article 12 (Governing Law and Jurisdiction)

本規約の解釈および適用は日本法に準拠します。本サービスに関する紛争については、当社の本店所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes relating to the Services shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company's registered office as the court of first instance.
